2. What these terms cover

These terms govern your use of 128kb.eu and your membership as a creator. By creating an account you agree to them. If you do not agree, please do not create an account.

128KB is a free, non-commercial platform for creative coding within a 128 kilobyte limit. We charge nothing and we owe no guaranteed availability — see section 8.

You keep the copyright in everything you submit. We claim no ownership.

By submitting a GIF you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and publish it on 128KB, and to reproduce it in material that promotes 128KB and the work shown on it (for example social media posts and the site’s own pages), with attribution to you.

This licence exists only so we can run the site and show your work. It ends when you or we delete the work — except for copies already made in good faith, such as an existing social media post, which we cannot always retract.

We may remove any submission that breaches this, and suspend or delete the account behind it.

6. Moderation

Submissions are reviewed before publication. We decide what gets published, and we may decline or later remove anything without giving reasons. This is a curated platform, not a neutral host.

If you believe something on 128KB infringes your rights, email post@timrodenbroeker.de with enough detail to identify it and we will act promptly.

7. Deleting your account

You may delete your account at any time via Edit Profile → Delete my profile in the user menu.

Deleting your account also deletes every GIF you have submitted, permanently and immediately. If you would rather your work stayed online, contact us before you delete.

We may suspend or delete your account if you breach these terms, or if the account is inactive for an extended period after notice.

8. Availability and liability

128KB is provided free of charge and “as is”. We do not guarantee that it will be available, uninterrupted, or error-free, and we may change or discontinue it at any time.

Please keep your own copies of your work. We are not a backup service and are not liable for loss of submitted material.

We are liable without limitation for injury to life, body, or health, and for damage caused intentionally or by gross negligence. For slight negligence we are liable only where an essential contractual obligation (a Kardinalpflicht) is breached, and then only for foreseeable, typical damage. Liability under the German Product Liability Act is unaffected.

9. Links and embedded tools

We are not responsible for the content of external sites we link to.

10. Changes to these terms

We may amend these terms. If a change materially affects you, we will notify registered members by email. Continuing to use your account after a change means you accept the amended terms.

11. Governing law

These terms are governed by the law of [[Germany]], excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, mandatory consumer protections of your country of residence remain unaffected.

Online dispute resolution: The European Commission provides a platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Severability

If any provision is or becomes invalid, the remainder stays in force.
